Terms of Service

These Terms of Service ("Terms") govern your access to and use of Instora ("Service"), operated by Instora ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the Service after changes take effect constitutes acceptance.

Instora is a SaaS platform that uses artificial intelligence to generate real estate marketing content — including social media posts, video scripts, property landing pages, and QR codes — from listing details and photos provided by you.

The Service is intended for real estate professionals including licensed agents, brokers, and their teams. You must be at least 18 years old and legally capable of entering into contracts to use the Service.

You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately at legal@instora.io if you suspect unauthorised access.

You may not share your account credentials with others. Team plan members must each have their own account. You may not create accounts for the purpose of abusing free trials or circumventing usage limits.

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or are inactive for an extended period.

Instora offers paid subscription plans billed monthly. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

• Starter — $29 per month, 5 listings per month
• Pro — $79 per month, unlimited listings
• Team — $199 per month, 50 shared listings per month across up to 10 members

All fees are in US dollars and are non-refundable except where required by law or at our sole discretion. Prices may change with 30 days notice.

Monthly usage limits reset at the start of each billing cycle. Unused listings do not roll over.

You may cancel your subscription at any time from the billing page. Cancellation takes effect at the end of the current billing period — you retain access until then.

Payments are processed by Stripe. By subscribing you also agree to Stripe's terms of service.

You agree to use Instora only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to generate content that is false, misleading, or fraudulent about a property
• Upload photos or content that you do not have the right to use
• Use the Service to violate any applicable real estate law, fair housing law, or advertising regulation
• Attempt to reverse engineer, scrape, or extract data from the Service
• Circumvent usage limits, authentication, or security measures
• Use the Service in a way that could damage, disable, or impair it
• Resell or white-label the Service without our written permission

You retain ownership of all listing details, photos, and other content you submit to Instora ("Your Content"). By submitting content, you grant us a limited licence to store, process, and use it solely to provide the Service to you.

You represent and warrant that you have all rights necessary to submit Your Content and that it does not infringe any third-party rights.

You are solely responsible for the accuracy of listing information you enter. Instora is a content generation tool — we are not responsible for inaccuracies in marketing materials that result from incorrect information you provide.

The marketing content Instora generates is produced by AI and is provided as a starting point. You are responsible for reviewing all generated content before publishing or distributing it. We make no guarantee that AI-generated content is accurate, complete, compliant with applicable regulations, or suitable for your specific use case.

Real estate advertising is subject to regulation by local, state, and federal law including fair housing laws. You are solely responsible for ensuring that content you publish complies with all applicable laws and regulations.

When you generate a marketing kit, Instora creates a publicly accessible landing page for your listing. You acknowledge that this page is visible to anyone with the link. You are responsible for the content that appears on these pages.

We reserve the right to remove public listing pages that violate these Terms or applicable law.

The Instora name, logo, platform, and all associated software, designs, and content created by us are our intellectual property and are protected by applicable law. These Terms do not grant you any rights to use our trademarks, logos, or branding.

AI-generated marketing content produced for your listings is provided to you for your use. We do not claim ownership of generated output.

Instora integrates with third-party services including Stripe (payments), Anthropic (AI generation), and Supabase (data storage). Your use of these services through Instora is also governed by their respective terms. We are not responsible for the practices or content of third-party services.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that AI-generated content will meet your requirements or be fit for any particular purpose.

To the maximum extent permitted by applicable law, Instora and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the three months preceding the claim.

You agree to indemnify and hold harmless Instora and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party rights.

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable period following termination. Billing records are retained as required by law.

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
